Platform Agreement &
Terms of Service

Welcome to Aurgo. These terms govern your rights and responsibilities when participating in the Aurgo ride-sharing and logistics marketplace.

1. Acceptance of Terms

By downloading, installing, registering, or using the Aurgo application, websites, or matching services, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service. If you do not agree to these terms, you must immediately cease all access and uninstall the applications. These terms govern the relationship between users and Aurgo Technologies, S.R.L.

2. Eligibility & Verification

All individual users must be at least 18 years of age. Driver Partners must submit valid driver's licenses, clean criminal background sheets, and vehicle registration cards. Merchants must supply active business tax registry certificates (RNC) and keep product descriptions accurate. Corporate accounts must designate an authorized administrator who manages corporate employee ride rosters.

3. Intermediary Platform Disclaimer

Aurgo acts exclusively as a digital marketplace intermediary. Aurgo does not provide direct passenger transportation, taxi services, or logistics shipping. Independent Driver Partners are third-party contractors and are not employees, agents, or representatives of Aurgo. Similarly, Merchants operate their own kitchens or warehouses independently. Aurgo is not liable for safety incidents, quality deficiencies, or conduct during trip execution.

4. Fares, Taxes, and ITBIS

Fares are computed based on trip distance, duration, and supply-demand ratios (surge pricing multipliers). All client estimates are inclusive of the Dominican Republic 18% ITBIS tax. Weekly payouts to Driver Partners are processed electronically to their linked bank accounts, minus Aurgo's 35% platform commission.

5. NCF Sequences & Corporate Withholding

To support tax compliance in the Dominican Republic: (a) Invoices are generated using legal Número de Comprobante Fiscal (NCF) sequences, utilizing prefix B01 for corporate fiscal credits, B02 for final consumer transactions, and B04 for informal providers; (b) Corporate client transactions are subject to a 2% Income Tax (ISR) withholding deducted at the source, matching local fiscal ordinances.

6. Limitation of Liability

To the maximum extent permitted by Dominican law, Aurgo Technologies, S.R.L. is not liable for indirect, incidental, special, or consequential damages (including personal injury, property loss, or business interruption) arising from transactions between Riders, Drivers, and Merchants. Aurgo's total liability shall not exceed the fees retained by the platform from your transactions in the past 6 months.

7. Dispute Resolution & Arbitration

These Terms of Service are governed by the laws of the Dominican Republic. All user groups—including riders, driver partners, corporate client administrators, and merchant partners—agree to first submit disputes to good-faith mediation. If unresolved, disputes shall be settled exclusively through binding arbitration in Santo Domingo, Dominican Republic.
